business communications

As a business owner or freelancer, staying compliant with legal requirements is crucial for maintaining trust and avoiding potential penalties, including when it comes to business communications. One such important regulation is outlined in Article 3 of Decree-Law No. 59/2021 of July 14th, which mandates specific disclosures related to customer communication channels.

What Does the Decree-Law Require?

According to this legislation, any entity that provides telephone lines for consumer contact must clearly and visibly disclose certain information across various communication platforms. This includes:

  • Commercial Communications: Any advertising or promotional content.
  • Website: The main page of your website must prominently feature the required details.
  • Invoices: Every invoice sent to consumers must include this information.
  • Written Communications: Any written correspondence with consumers.
  • Contracts: All consumer contracts, if they are in written form, must also contain this information.

What Information Needs to Be Disclosed?

The law specifically requires that you provide:

  • The telephone number(s) that consumers can use to contact your business.
  • Clear, visible, and up-to-date information regarding the cost of calls associated with these numbers.

Why Is This Important?

Failure to comply with these requirements can lead to legal repercussions and damage your business’s reputation. Ensuring that all your communications, including invoices, websites, and contracts, meet these standards, you protect your business and provide transparency to your customers.

Taking Action

If you haven’t already, now is the time to review your invoices and other consumer-facing documents to ensure they comply with Article 3 of Decree-Law No. 59/2021. Ensuring compliance is not just a legal obligation—it’s a key part of maintaining consumer trust and fostering long-term relationships.

Stay compliant, stay trusted!
